The problem is that the laws weren't that clear.

The first source for the law on elections is the Constitution. It's not very specific.

So then there are statutes. He mentions the Electoral Count Act of 1887. But one can always contest the validity of statutes -- especially when there are constitutional underpinnings.

And I haven't researched it, but I don't think there's a body of case law on the validity of such laws and/or clarifying them. And that leaves room for challenges.

And what might be noteworthy is that last year Congress passed an Electoral Reform Act. And its reason for doing so is that the 1887 act doesn't provide clear guidance on counting votes or resolving disputes. The reform act even clarified the VP's role.

The legislative history for the reform act might provide Trump and his lawyers part of their defense....
