Tanya S. Chutkan, the partisan judge presiding over Trump’s DC federal insurrection case is an Obama-appointed, pro-BLM hack. She needs to be immediately dismissed.
Chutkan is biased towards the Democratic view that January 6, though far less lethal and destructive, “trumps” the horrific violence that occurred across dozens of cities in the Summer of Insurrection
On Wednesday, August 2, partisan special counsel Jack Smith indicted Donald J. Trump in The Swamp’s preferred jurisdiction of Democrat-dominated Washington DC. There, in the Elijah Barrett Prettyman Federal Courthouse, will preside Obama-appointed and Hunter Biden legal colleague (Boies Schiller Flexner) Judge Tanya S. Chutkan. Trump could not have had worse luck.
Chutkan is best known for throwing the book at peaceful oldsters who were simply present at the Capitol on January 6, though she was not nearly as bothered by the violent, thieving, vandalizing rioters who brought DC to its knees during the Dem-enabled, Dem-encouraged 2020 Summer of Insurrection. Chutkan declaimed in court to one January 6 protester that it was a false equivalence “to compare the actions of people protesting, mostly peacefully, for civil rights” [to the mob that] '“was trying to overthrow the government.” Doing that, she claimed, “ignores the very real danger that the Jan. 6 riots pose to the foundation of our democracy.”
That this DNC-groomed partisan trucks in the “mostly peaceful protesters” lie is both laughable and dangerous. That she does not grasp that the whole foundation of BLM theology is rooted in a canard about why black people are arrested so disproportionately to their small share of the overall population (answer: blacks commit a disproportionately greater share of violent crime) is also disturbing. That she does not consider the BLM/Antifa protesters as members of a “mob” is insane.
But most disgraceful is that this Democrat judge actually believes that the speech she likes is more judicially privileged than speech she does not like. The truth is that all political violence is wrong. All of it should be judged equally, whatever the justification.
How did we ever get to this wacky injudicious place in America where some political violence is privileged over others because “the cause” is randomly considered more just?
But Judge Chutkan should not be dismissed merely because her political affiliation is clearly different than that of the defendant. As Judge Blumenthal admonished in U.S. vs. Jeff Fortenberry, if the political affiliation of a judge was the ultimate delimiter in federal cases, then there could be no such thing as a fair judge. Nor should Chutkan be dismissed because the likes of the egregious LA Times consider it “poetic justice” that a sisterhood of black legal minds sit in judgment across multiple jurisdictions on the man that far-left racialists caricature as some modern-day George Wallace when, in fact, Trump did more to improve the lot of African-Americans than all old and new Jim Crow Democrats combined.
But questions of overt judicial bias and animus against a defendant and his supporters are a whole other matter. Judge Chutkan is clearly biased towards the delusional Democratic view that January 6, though far less lethal and destructive, “trumps” the horrific violence that occurred in dozens of cities and against multiple federal buildings during the Black Lives Matter/Antifa insurrections of 2020. She went far beyond prosecutorial sentencing guidelines in meting out overly harsh punishments to January 6 spectators. And she ruled against Trump in a separate presidential records case, siding with the highly partisan, Democrat-dominated January 6 Committee. Moreover, she expressed clear animus towards Trump when she complained to a January 6 defendant: “The people who exhorted you and encouraged you and rallied you to go and take action and to fight have not been charged.”
The evidence is staggering: there is zero chance that Trump can expect a fair trial with this overtly partisan judge presiding over a historically monumental case in a city that votes overwhelmingly Democrat. Judge Tanya Chutkan needs to be immediately dismissed and Mr. Trump needs to be granted a change of venue where he can genuinely stand before a jury of his peers.
